Consent to Personal Data Processing

  1. CADprofi A.Czubek, J.Kosiorek s.c. is the administrator (controller) of personal data of users in accordance with the European Parliament and Council Regulation (EU) 2016/679 of 27 April 2016 (GDPR), processed for the purpose of providing services covered by these regulations. The Administrator processes personal data of users using the online store, software, and websites available at cadprofi.com and e-cadprofi.com, as well as individuals contacting the Administrator via forms, e-mails, social media (in particular Facebook, LinkedIn, YouTube), and in connection with commercial and marketing activities. Personal data may also be processed by entities cooperating with the Administrator—CADprofi distributors involved in software sales, distribution, and after-sales support, as well as partners participating in CADprofi OEM/CP-Manufacturers programs, who depending on the nature of cooperation may act as data processors on behalf of the Administrator, separate controllers, or joint controllers to the extent necessary for sending commercial information and newsletters. Although our privacy policy is based on the strict requirements of the GDPR, we apply the same high standards of personal data protection to all our customers worldwide. Our goal is to ensure a consistent and secure data management environment regardless of your geographical location.

  2. Providing personal data by the user is voluntary but necessary for concluding and performing a contract, in particular for license registration, creating a user account, fulfilling orders, complying with accounting and tax obligations, conducting marketing activities regarding the Administrator’s products and services, and using the functionality of the online store and CADprofi software. Data is provided by the user during license registration in the program or on the cadprofi.com website, as well as when making corrections or updates.

  3. Each user has the right to access their personal data, correct, rectify, delete, or limit processing, object to data processing, transfer their data, and lodge a complaint with the supervisory authority (President of the Personal Data Protection Office). Exercising these rights, including regarding data obtained indirectly (e.g., from publicly available social media profiles such as Facebook, LinkedIn, YouTube, from CADprofi distributors, or partners participating in CADprofi OEM/CP-Manufacturers programs) is done via contacting the Administrator using the contact details indicated in this privacy policy.

  4. The Administrator collects and stores the following user data:
    1. first and last name,
    2. company name,
    3. VAT number (for business customers),
    4. residential or business address,
    5. phone number,
    6. email address,
    7. position (e.g., from publicly available social media profiles),
    8. other information made publicly available by the user or provided by CADprofi distributors or partners participating in CADprofi OEM/CP-Manufacturers programs in connection with contract execution, support, and business contacts.
  5. Personal data is processed primarily to conclude and execute contracts, including license registration and management, maintaining user accounts, fulfilling orders; providing technical support, licensing information, and after-sales service; fulfilling accounting and tax obligations; marketing the Administrator’s products and services, including newsletters; marketing and commercial contact with users and individuals whose data was obtained indirectly—e.g., from publicly available profiles, distributors, or partners participating in CADprofi OEM/CP-Manufacturers programs, to the extent necessary for sending commercial information and newsletters; analyzing website traffic and generating anonymous statistics (e.g., Google Analytics).

  6. User data will be processed by the Administrator for the duration of an active program license, and after license expiration, for the period required by applicable law to handle complaints and claims related to program use. Data required by law—including tax and accounting obligations—will be stored for the period specified by applicable law. Direct data processed for marketing purposes (provided by the user, e.g., during license registration) will be retained as long as the user consents to receiving newsletters and commercial information. Indirect data (obtained from social media or from distributors or partners participating in CADprofi OEM/CP-Manufacturers programs) will be stored to the extent necessary for sending marketing information and managing business contacts. Users can withdraw their consent at any time, which will result in stopping further marketing communications. After the indicated periods, data will be deleted or anonymized upon user request as specified in EU regulations.

  7. The Administrator may share user data only to the extent necessary to achieve the processing purposes outlined in this privacy policy. In particular, data may be transferred to cooperating entities, including IT, hosting, and service providers; accounting, legal, and payment service providers; entities providing sales and after-sales support, including technical support and customer service; CADprofi software distributors operating in Poland and other countries; partners participating in CADprofi OEM/CP-Manufacturers programs, where processing occurs under data processing agreements or according to GDPR rules for joint or separate controllers. In the case of the e-cadprofi.com service, data may be transferred to other entities (including those outside the European Economic Area) if necessary to provide technical, sales, after-sales, or accounting support. Transfers outside the EEA occur in compliance with GDPR requirements, including the use of Standard Contractual Clauses (SCC) approved by the European Commission or other legally acceptable mechanisms ensuring an adequate level of data protection. Data may also be shared with third parties for marketing purposes, including partners in CADprofi OEM/CP-Manufacturers programs and the international CADprofi distributor network, to the extent necessary to send newsletters and commercial information, provided the user has consented.

  8. All data collected by the Administrator under this regulation is protected using reasonable technical, organizational, and security measures to prevent unauthorized access or misuse.

  9. Consent to personal data processing can be withdrawn at any time. However, withdrawing consent results in the license not being assigned to the user, and therefore the loss of rights to program updates, technical support, and licensing information.


Marketing Consent Granted During License Registration

  1. The user agrees to receive newsletters and commercial information sent electronically. Messages relate mainly to program updates and promotional offers.

  2. Providing consent for receiving marketing content is voluntary. Lack of consent does not affect the use of standard paid licenses. In the case of demo versions of CADprofi or CADprofi OEM/CP-Manufacturers programs, consent for marketing data processing allows the user to use these demo programs under the Administrator’s business model. The business model is based on providing free demo versions while enabling marketing contact with users. Without consent, the user will not have access to full functionality of demo programs and should uninstall them.

  3. Consent for marketing communication can be withdrawn at any time. If personal data has already been transferred to third parties (e.g., partners in CADprofi OEM/CP-Manufacturers programs), the withdrawal applies only to data currently processed by CADprofi.


Sources and Scope of Personal Data Collection

  1. All data obtained while using cadprofi.com and e-cadprofi.com is collected to generate anonymous statistics as well as to provide sales and after-sales services. Additionally, law requires data processing for tax and accounting purposes.

  2. Personal data may also be obtained indirectly by the Administrator, in particular from publicly available profiles and content on social media such as Facebook, LinkedIn, and YouTube, limited to names, company, position, contact details, and other information made publicly available by the user; from CADprofi distributors in connection with commercial activities, inquiries, contract execution, and after-sales support; and from partners participating in CADprofi OEM/CP-Manufacturers programs related to providing the software to end users. Data collected from social media is limited to publicly available information.

  3. Users who do not want their data to be used for collecting anonymous statistics may install a browser add-on to block Google Analytics.


Cookies and Analytics Tools

The CADprofi website uses cookies and analytics tools that enable proper website functionality, service quality improvement, and analysis of user traffic and preferences. Cookies required for website and user account operation do not require consent. Users can consent to or refuse functional, analytical, and marketing cookies in the cookie settings panel or browser settings. Disabling cookies may limit website functionality or prevent access to some services. Users who do not want their data collected for analytics purposes may install browser add-ons blocking Google Analytics or other analytics tools, in accordance with their right to object to processing for marketing/statistical purposes.

Data collected through cookies may also be shared with external entities such as Facebook, LinkedIn, YouTube, CADprofi distributors, and partners participating in CADprofi OEM/CP-Manufacturers programs that use analytics or marketing tools, including entities outside the European Economic Area, in accordance with applicable law and the privacy policies of those entities.

Processing data for analytical and statistical purposes is based on the legitimate interest of the Administrator.
